Please read the present Terms and Conditions (“Terms”, or “Terms and Conditions”) carefully before using https://thedermolab.com website (“The Dermo Lab”, or “Website”) operated by Pierre Fabre Moyen Orient SARL (PFMO). The Terms and Conditions outline the rules and regulations for the use of The Dermo Lab.

2.6       Parts of the Website offer an opportunity for users to post and exchange opinions and information in certain areas of the Website. PFMO does not filter, edit, publish or review comments prior to their presence on the Website. Comments do not reflect the views and opinions of PFMO, its agents and/or affiliates. Comments reflect the views and opinions of the person who post their views and opinions. To the extent permitted by applicable laws, PFMO shall not be liable for the comments or for any liability, damages or expenses caused and/or suffered as a result of any use of and/or posting of and/or appearance of the Comments on the Website.

2.7       PFMO reserves the right to monitor all posted comments and to remove any comments which can be considered inappropriate, offensive or causes breach of these Terms and Conditions.

2.8       You warrant and represent that:

(a)        You are entitled to post the comments on the Website and have all necessary licenses and consents to do so;

(b)        The comments do not invade any intellectual property right, including without limitation copyright, patent or trademark of any third party;

(c)        The comments do not contain any defamatory, libelous, offensive, indecent or otherwise unlawful material which is an invasion of privacy

(d)        The comments will not be used to solicit or promote business or custom or present commercial activities or unlawful activity.

(e)        You hereby grant PFMO a non-exclusive license to use, reproduce, edit and authorize others to use, reproduce and edit any of your comments in any and all forms, formats or media.

2.9       PFMO reserves the right to restrict access to areas of The Website, or indeed to the whole Wbsite, at their discretion; you must not circumvent or bypass, or attempt to circumvent or bypass, any access restriction measures on the Website.

3.1       You must not:

(a)        Use the Website in any way or take any action that causes, or may cause, damage to the Website or impairment of the performance, availability or accessibility of the Website;

(b)        Use the Website in any way that is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity;

4.1       The following organizations may link to the Website without prior written approval:

4.2       PFMO may consider and approve other link requests from the following types of organizations:

(a)        Commonly-known consumer and/or business information sources;

(e)        Accounting, law and consulting firms; and

(f)        Educational institutions and trade associations.

4.3       PFMO will approve, in its discretion, link requests from the organizations listed in above 4.2 and providing: (a) the link would not make PFMO look unfavorably to itself or to its accredited businesses; (b) the organization does not have any negative records with PFMO; (c) the benefit to PFMO from the visibility of the hyperlink compensates the absence of PFMO; and (d) the link is in the context of general resource information.

4.4       The organizations referred to in above 4.2 may link to PFMO’s home page so long as the link: (a) is not in any way deceptive; (b) does not falsely imply sponsorship, endorsement or approval of the linking party and its products or services; and (c) fits within the context of the linking party’s site.

4.5       If you are one of the organizations listed in 4.2 above and are interested in linking to the Website, you must inform us by sending an e-mail to blog@thedermolab.com. Please include your name, your organization name, contact information as well as the URL of your site, a list of any URLs from which you intend to link to the Website, and a list of the URLs on our site to which you would like to link.

4.6       Approved organizations may hyperlink to the Website as follows:

(a)        By use of PFMO’s corporate name or The Dermo Lab’s name; or

(b)        By use of the uniform resource locator being linked to; or

(c)        By use of any other description of the Website being linked to that makes sense within the context and format of content on the linking party’s site.

4.7       No use of PFMO’s logo or other artwork will be allowed for linking absent a trademark license agreement.

5.2       PFMO has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites or services. You further acknowledge and agree that PFMO shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.

Without prior approval and written permission, you may not create frames around our Webpages that alter in any way the visual presentation or appearance of the Website.

  1. Limited warranties

7.1       PFMO does not warrant or represent:

(a)        The completeness or accuracy of the information published on the Website;

(b)        That the material on the Website is up to date; or

(c)        That the Website or any service on the Website will remain available.

7.2       PFMO reserves the right to discontinue or alter any or all of the Website’s services, and to stop publishing the Website, at any time in its sole discretion without notice or explanation; and save to the extent expressly provided otherwise in these Terms and Conditions, you will not be entitled to any compensation or other payment upon the discontinuance or alteration of any of the Website’s services, or if PFMO stops publishing the Website.

  1. Limitations and Exclusions of Liability

8.1       PFMO will not be liable to you in respect of any losses arising out of any event or events beyond PFMO’s reasonable control.

8.2       PFMO will not be liable to you in respect of any business losses, including (without limitation) loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill.

8.3       PFMO will not be liable to you in respect of any loss or corruption of any data, database or software.

8.4       PFMO will not be liable to you in respect of any special, indirect or consequential loss or damage.

8.5       FFMO shall not be held responsible for any content that appears on your website. You agree to protect and defend PFMO against any and all claims and liabilities that PFMO may sustain as a result of the use of any of the Website’s data on your website. No link(s) should appear on any website (including, if applicable, your website) that may be interpreted as libelous, obscene or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.

  1. Breaches of these Terms and Conditions

10.1     Without prejudice to PFMO other rights under these Terms and Conditions, if you breach these Terms and Conditions in any way, or if PFMO reasonably suspect that you have breached these Terms and Conditions in any way, PFMO may:

(a)        Send you one or more formal warnings;

(b)        Temporarily suspend your access the Website;

(c)        Permanently prohibit you from accessing the Website (either by locking computers using your IP address from accessing the Website; or by contacting any or all of your internet service providers and request that they block your access to the Website); and/or 

(d)        Take legal action against you, whether for breach of contract or otherwise.

10.2     Where PFMO suspends or prohibits or blocks your access to the Website or a part thereof, you must not take any action to circumvent such suspension or prohibition or blocking.

11.1     PFMO may revise the Terms and Conditions any time.

11.2     The revised Terms and Conditions shall apply to the use of the Website from the date of publication of said revised Terms and Conditions on the Website, and you hereby waive any right you may otherwise have to be notified of, or to consent to, the revisions of the Terms and Conditions.

PFMO reserves the right to request that you remove all links or any particular link to the Website and you undertake to remove any and all links to the Website upon PFMO’s request.

  1. Assignment

13.1     You hereby agree that PFMO may assign, transfer, sub-contract or otherwise deal with its rights and/or obligations under these Terms and Conditions.

13.2     You may not without PFMO’s prior written consent assign, transfer, sub-contract or otherwise deal with any of your rights and/or obligations under these Terms and Conditions.

  1. Severability

14.1     If a provision of these Terms and Conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect.

14.2     If any unlawful and/or unenforceable provision of these Terms and Conditions would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

  1. Entire agreement

Subject to above 8, these Terms and Conditions, together with PFMO’s Privacy Policy, shall constitute the entire agreement between you and us in relation to your use of the Website and shall supersede all previous agreements between you and PFMO in relation to your use of the Website.

  1. Law and jurisdiction

16.1     These terms and conditions shall be governed by and construed in accordance with Lebanese Law.

16.2     Any disputes relating to these Terms and Conditions shall be subject to the competent Lebanese courts.
